At Forfar the 25th day of January eighteen hundred and forty three years in presence of Andrew Robertson Esquire commissary depute of the commissariat of Forfar. Compeared Charles Catanach Farmer in East Mains of Dunnichen one of the executors of the deceased Thomas Fyffe residing at Balardie, who being solemnly sworn and examined that the said Thomas Fyffe died on or about twentieth day of November eighteen hundred and forty one and the deponent has entered upon the possession and management of the deceased's personal estate along with Mr. Alexander Dixon Farmer at Wemyss as executors nominated by him in the deed of settlement executed by him upon the twenty eighth day of January eighteen hundred and thirty five and codocil thereto annexed dated the eleventh day of November eighteen hundred and forty one and registered in the Sheriff court books of Forfarshire the tenth day of November eighteen hundred and forty two an extract whereof is now exhibited and signed by the deponent and said commissary depute as of this date relative hereto that the deponent does not know of any settlement or writing relative to the disposal of the deceased's personal estate or effects or any part of them other than those now exhibited; that the said inventory, which is signed by the deponent and said commissary depute is a full and true inventory of all the personal or movable estate and effects of the said deceased Thomas Fyffe wheresoever situated in belonging or due beneficially to the deceased at the time of his death in so far as the same has come to the deponent's knowledge and that they knew of the said State situated in Scotland is of the value of one hundred pounds Stirling and under the value of two hundred pounds Stirling all which is true as the deponent shall answer to God (signed). At Forfar the tenth day of November one thousand eight hundred and forty two years in presence of James Laney Esq. Advocate Sherriff of Forfarshire Compeared John Tyndall writer in Forfar as procurator and gave in the settlement and Codicilthereto subjoined underwritten, desiring that the same might be registered in his Lordships Court Books in terms of the clause of registration therein contained, which desire the said Sheriff finding to be reasonable he ordered the same to be done accordingly and whereof the tenor follows indelicit. I ThomasFyffe, quarrier residing at Balardie being resolved to settle my affairs so as to prevent all disputes after my death in regard to succession to my movable means and estate. Do hereby make constitute and appoint Charles Catanach residing at Westerton of Balgairs. my son-in-law to be my sole executor and administrator with full power to him to introuat??? with my whole movable estate and executry of every description, and specially without prejudice to the foresaid generality with my thirty second share or interest in the Brig Isabella of Dundee, and to give up inventries of my said movable estate and executry to confirm the same and generally to do anything in the premises? competent to an executor.
Declaring always as it is expressly hereby provided and declared that the said Charles Catanach as executor forsaid shall be accountable to the residuary legatees herein after named for his intermissions?? in virtue hereof, after payingall my lawful debts, deathbed and funeral charges and the necessary expenses to be laid out in confirming and recovering my said means and estate and whatever residue there may be of said means and estate falling under this testament and presently belonging to me or that may belong to me at the time of my death I ordain the same to be accounted for and paid over by my said executor to my children after named, whom I hereby appointed to be my Residuary Legatees namely first Charles Fyffe presently residing in the Asylum for the Blind at Edinburgh. Second Mary Fyffe residing in Dundee, relict of the deceased Thomas Fyffe late master of the brig Isabella of Dundee; third James Fyffe residing at Truro in Nova Scotia, North America and fourth Charlotte Fyffe wife of the said Charles Catanach, and that in four equal shares one whereof to belong to each of my children before named; and declaring that in case of the decease of any of them before me leaving lawful issue the share of the deceased shall belong to his or her children equally among them share and share alike. Declaring also that as my son John Fyffe late Mason at New Orleans, America died sometime go leaving a widow and two children, and as I am not well informed in what circumstances these children are left, it is my wish that if they are in necessity, they shall receive a share of my said estate, along with my other legatees before named in which case the said residue will be divided into five instead of four shares, and one fifth shall belong to each of the said Charles Mary James and Charlotte Fyffe and the remaining fifth to the children of the said deceased John Fyffe and a survivor of them, but I hereby give full power to the said Charles Catanach, after consulting my said residuary legatees resident in this kingdom to give or to withhold this share according as they shall ascertain the circumstances."2 - (Bride) Marriage*: Charlotte Fyfe married Charles Cattanach, son of Duncan Cattanach and Agnes Fyfe, on 7 February 1823 at Aberlemno, Forfarshire, Scotland, .
